Terms of Service

Chen Wenjiang ("we", "us", or "our") is an individual / sole trader operating under the laws of the People's Republic of China, providing YesNoTarot.org (the "Service").

1. Introduction & Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Service, an AI-powered tarot reading platform available at yesnotarot.org.

By creating an account, subscribing to a plan, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.

If you do not agree to these Terms, you may not use the Service. Continued use after any update constitutes acceptance of the revised Terms.

2. Service Description

2.1 What We Provide

The Service provides AI-generated tarot readings, including yes/no readings, love readings, and a daily tarot reading. A limited number of readings may be available without charge.

Usage limits differ for anonymous visitors, registered users, and subscribers, and may be adjusted to prevent abuse, protect the Service, or manage capacity.

2.2 Nature of the Service

The Service is a digital, intangible product delivered over the internet. Access is normally granted to your account immediately upon confirmed payment. Because delivery is immediate, specific limitations apply to refunds as described in Section 7.

2.3 Entertainment Purpose and No Professional Advice

Tarot readings are provided for entertainment and personal reflection only. They are not predictions, and they do not constitute medical, legal, financial, psychological, safety, or any other form of professional advice. Do not rely on a reading as the sole basis for an important decision. You remain solely responsible for your choices and actions.

2.4 Third-Party AI Model Providers

The Service uses third-party AI model providers — which may include Google, Alibaba (Qwen), and OpenAI, accessed through OpenRouter — to generate reading interpretations. Service performance and availability may be affected by the operational status of these providers. We will endeavor to communicate significant disruptions in a timely manner.

3. Account Registration & Eligibility

3.1 Account Creation

Some features require an account. You agree to provide accurate and complete information, to keep your login credentials secure, and to keep your billing email address up to date. You are responsible for all activity carried out through your account.

3.2 Account Security

• Notify us immediately of any unauthorized use at support@yesnotarot.org.
• Do not share your credentials with any third party.
• You must be at least 18 years old, or the age of legal majority where you live, to purchase a subscription.

3.3 Business Accounts

If you register on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

We may suspend or terminate accounts that violate these Terms, misuse the Service, attempt to bypass usage limits, or create security or operational risks.

4. Subscription Plans

We offer subscription plans for access to the Service. The current plan details and pricing are displayed on the Pricing page. The Premium plan is offered at USD 5.90 per month or USD 56.64 per year, unless a different price is clearly shown before checkout.

A subscription grants access to unlimited yes/no and love readings, an ad-free experience, and a longer reading-history retention period. Daily tarot readings remain subject to a once-per-day limit.

A subscription also grants chat credits for the tarot reader chat: 1,000 credits for each monthly billing period, or 12,000 credits for each yearly billing period. Credits are granted at the start of the period they belong to and lapse at the end of it — unused credits do not carry over. They are spent only in the tarot reader chat, at the rates shown there.

We reserve the right to modify plan features or introduce new plans at any time. Price changes are governed by Section 5.

5. Billing & Payment

5.1 Recurring Billing Authorization

By providing your payment method and subscribing to a paid plan, you expressly authorize us to charge your payment method on a recurring basis for the applicable subscription fee. Your subscription renews automatically at the end of each billing period at the selected interval (monthly or yearly) unless cancelled in accordance with Section 6. This recurring authorization remains in effect until you cancel.

5.2 Payment Processing

Payments are processed by third-party payment providers and merchants of record. The provider shown at checkout processes your payment details under its own buyer terms and privacy policy, and is responsible for invoicing, applicable taxes, receipts, and chargebacks on its own account. The provider's name may appear on your receipt or card statement.

Providers currently available through the Service may include Waffo Pancake. We may add, remove, or replace providers over time.

5.3 Taxes

Prices are exclusive of applicable taxes (including VAT, GST, sales tax, or similar) unless otherwise stated. Where required by applicable law, such taxes are calculated and collected at checkout by the payment provider or merchant of record acting as the seller of record.

5.4 No Physical Goods

Paid subscriptions are digital services. No physical goods are shipped.

6. Cancellation Policy

6.1 How to Cancel

You may cancel your subscription at any time through:

• Online (recommended): sign in and go to Account Settings → Billing → Cancel subscription
• Email: send a cancellation request from your registered email address to support@yesnotarot.org

Cancellation takes effect immediately. Your subscription status is updated in your account right away.

6.2 Effect of Cancellation

• Your subscription remains active until the end of the current paid billing period.
• You will not be charged for subsequent billing periods.
• Your account remains available after cancellation so you can resubscribe or retain your reading history, until you ask us to delete it.
• Cancelling a subscription does not by itself refund charges already paid. See Section 7.

7. Refund Policy

7.1 General Policy

Because our services are digital and are delivered immediately, subscription fees are generally non-refundable, except as expressly stated below or as required by applicable law.

7.2 Eligible Refunds

• Free trial: A first-time subscriber gets 7 days free before any charge, including the chat credits described in Section 4 for that period. Cancel before the trial ends and nothing is charged; the credits granted for the trial lapse when it ends. After the trial the subscription renews at the price shown at checkout until cancelled.
• Duplicate or erroneous charge: A full refund for any billing error resulting in a duplicate charge, or for a charge not authorized under these Terms.
• Verified service outage (72 hours or more): A pro-rated refund or credit for an extended outage that is within our control and that prevents you from using the Service.
• Statutory rights: Where applicable law grants withdrawal or refund rights — for example, the 14-day withdrawal right available to consumers in the EU and UK — those rights are preserved and are not affected by this Section.

7.3 How to Request a Refund

Contact support@yesnotarot.org with your account email address, the transaction identifier (if available), and the reason for the request. We will acknowledge within 2 business days and process eligible refunds within 5–10 business days. Approved refunds are returned through the original payment method; the time to appear depends on the payment provider and your financial institution.

7.4 Non-Refundable Items

• Fees for subscription periods that have already been used, except as stated in Section 7.2.
• Accounts terminated for a violation of these Terms or of the Acceptable Use Policy in Section 10.

8. Billing Disputes

If you believe there is an error in a charge, please contact us at support@yesnotarot.org before disputing the charge with your bank or card issuer. We commit to responding within 2 business days and to resolving confirmed billing errors within 5 business days.

Nothing in this Section limits your right to contact your bank or card issuer, or any non-waivable rights you have under applicable law.

9. AI Output & Intellectual Property

9.1 Ownership of Outputs

Subject to these Terms, AI-generated content produced in response to your inputs ("Outputs") may be used by you for any lawful personal purpose consistent with Section 10.

9.2 Input License

By submitting content to the Service ("Inputs"), you grant us a limited, non-exclusive licence to process your Inputs solely to deliver the Service — generating your reading, providing your account history, and maintaining security. We do not sell your Inputs, and we do not use them to train AI models.

9.3 Our Intellectual Property

The website, software, design, branding, and original content of the Service are protected by applicable intellectual property laws. These Terms give you a limited, personal, non-exclusive, non-transferable right to use the Service. They do not transfer ownership of the Service or its underlying technology.

9.4 Accuracy of AI Outputs

AI-generated content may contain errors or inaccuracies. You are solely responsible for reviewing and verifying Outputs before relying on them. See also Section 12.

10. Acceptable Use Policy

10.1 Permitted Uses

You may use the Service only for lawful, personal purposes in accordance with these Terms.

10.2 Prohibited Uses

You agree not to use the Service to:

• Generate content that is illegal, defamatory, harassing, or fraudulent
• Generate, distribute, or facilitate deepfake content — including AI-synthesized audio, video, or images — that impersonates a real individual or is intended to deceive viewers about its origin or authenticity
• Generate content that sexualizes minors or violates child protection laws
• Produce malware, phishing content, or cyberattack tools
• Infringe the intellectual property or privacy rights of any third party, or submit another person's private information without a lawful reason
• Circumvent or interfere with security features, usage limits, or payment requirements of the Service
• Attempt to gain unauthorized access to the Service or another user's account
• Interfere with, overload, scrape, reverse engineer, or disrupt the Service
• Resell or sub-licence access to the Service without our prior written approval
• Use automated means to access the Service without our written permission
• Violate any applicable law, regulation, or card network rule

10.3 AI-Specific Prohibitions

In addition to the general prohibitions above, given the AI-powered nature of the Service, you specifically agree not to:

• Use Service inputs, outputs, model responses, or any derivative of them to train, fine-tune, benchmark, distil, or otherwise develop any artificial intelligence or machine learning model that competes, directly or indirectly, with the Service
• Systematically scrape, extract, or harvest model outputs at scale for purposes other than your own authorized use of the Service
• Represent AI-generated Outputs as the work of a human professional — for example, a licensed doctor, lawyer, or financial adviser — in contexts where such a misrepresentation could cause harm

11. Data, Privacy & Security

Your use of the Service is governed by our Privacy Policy.

Payment card data is processed exclusively by our PCI-DSS certified payment processor (Waffo Pancake) and is not stored on our servers.

We apply reasonable technical and organizational measures intended to protect your information, including encryption in transit, hashed credentials, access controls, and signed payment notifications. If you believe a security issue affects your account, contact us immediately at support@yesnotarot.org.

12. Disclaimers & Limitation of Liability

12.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF AI OUTPUTS. We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

12.2 AI-Generated Content Disclaimer

⚠️ Outputs may be inaccurate, incomplete, or outdated. Do not rely on them for legal, medical, financial, or other professional advice. Always verify AI-generated content with a qualified professional before acting on it.

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSSES ARISING FROM DECISIONS MADE IN RELIANCE ON A TAROT READING. WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not apply where exclusion or limitation is prohibited by law, and nothing in these Terms limits any non-waivable consumer rights available to you.

13. Term & Termination

These Terms remain effective while you use the Service.

We may suspend or terminate your account if you materially breach these Terms, if we reasonably suspect fraudulent activity, or where required by law.

If we terminate your account for reasons other than your breach, we will provide a pro-rated refund or credit for any unused prepaid period.

You may stop using the Service at any time. To delete your account and associated personal information, contact us at support@yesnotarot.org.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the People's Republic of China, without regard to its conflict-of-law rules. This choice of law does not deprive you of the protection afforded by provisions of the law of your country of residence that cannot be derogated from by agreement.

Before initiating any formal proceedings, please contact us at support@yesnotarot.org so that we can attempt to resolve the matter informally. We will try to resolve complaints within 30 days.

15. General Provisions

We may update these Terms at any time. Material changes will be notified by email or by an in-product notice at least 15 days before the effective date. Continued use after the effective date constitutes acceptance of the revised Terms. The updated date appears at the top of this page.

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full effect.

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. We may assign or transfer our rights and obligations under these Terms; you may not assign yours without our consent.
